The Dodgers had until Friday to reinstate Bauer to the roster under baseball’s rules. The team has rarely commented on the divisive matter since Bauer was placed on paid administrative leave in July 2021.

MLB commissioner Rob Manfred suspended Bauer for 324 games for violating the league’s domestic violence and sexual assault policy after a San Diego woman said he beat and sexually assaulted her in 2021. Bauer said he did nothing wrong, adding that whatever happened between him and the woman was consensual.

The players’ union filed a complaint on Bauer’s behalf and a three-person panel headed by independent arbitrator Martin Scheinman began hearing the case last May.

In a decision on December 22, Scheinman upheld Manfred’s intended 194-game suspension instead of the intended 324-game penalty, and immediately reinstated Bauer. Scheinman confirmed that Bauer violated MLB policy and docked his salary for the first 50 games of 2023, with the pitcher on paid leave in 2021 and ’22.

Bauer joined his hometown Dodgers on a three-year contract worth $102 million ahead of the 2021 season. He had an 8–5 record and 2.59 ERA in 17 appearances before being placed on leave.

In the event Bauer is released, the MLB Players Association could challenge his release for noncompliance with the Uniform Player Contract.

The contract allows the team to be terminated if the player “fails, refuses or neglects to conform his personal conduct to the standards of good citizenship and good sportsmanship or to keep himself in first-class physical condition or to comply with the club’s training regulations”. adheres to” or “fails, in the opinion of the club’s management, to demonstrate sufficient skill or competitive ability to qualify for or continue as a member of the club’s team.”

In February 2022, Los Angeles prosecutors decided not to charge Bauer for the alleged beating and sexual assault of a San Diego woman because they said they were unable to prove her allegations beyond a reasonable doubt.

The woman, who was 27 at the time, said Bauer choked her unconscious, repeatedly punched her, and sexually assaulted her during two sexual encounters.

The Associated Press generally does not identify people who say they have been victims of sexual assault.

Bauer said in a video posted to YouTube after the prosecutor’s decision that he and the woman had engaged in rough sex at her suggestion and following guidelines they had agreed upon beforehand. He said that each encounter ended with her spending the night at his Pasadena home.

He said at the time, “The disturbing acts and conduct he described did not occur.”

The woman sought a restraining order, but a judge denied it. The judge found that Bauer respected the woman’s boundaries when the woman set them, and that she could not have known of those he had violated because she had not expressed them clearly.

Bauer will lose approximately $37.6 million in salary for the final 144 games of last season and the first 50 games of this season through May 23.

If Bauer is released, another team can sign him for the league minimum of $720,000, while the Dodgers are responsible for the remainder of $22,537,635.
